A documented Santa Paula gang member was shot Friday in Dodge City, Kansas while fleeing from law enforcement, the day after he and a second man allegedly robbed a bank at gunpoint.

According to the Dodge City Police Department, Angel Garcia Aguirre, 32, was shot by officers who were serving a warrant at a private residence related to the bank robbery, which occurred the day before. DCPD, Ford County Sheriff’s office, Kansas Bureau of Investigation and the Federal Bureau of Investigation executed the search warrant.

At about midnight on October 22, Aguirre, armed with a handgun, fled the home through a window. A press release from the U.S. Attorney in the District of Kansas stated Aguirre was carrying a handgun in the backyard of the residence.

When authorities ordered him to drop the weapon, he did not comply and tried to re-enter the house. Then officers shot him. Aguirre was transported to Western Plains Regional Hospital and later airlifted to Wichita, and reportedly remains in critical condition.

According to Dodge City Police, Aguirre is a fugitive from California with an extensive history of violent crime.

In March, Santa Paula Police arrested Aguirre after a brief foot pursuit, during which he allegedly discarded two handguns. Charges filed against Aguirre included suspicion of possession of a controlled substance, possession of a loaded firearm, possession of a stolen firearm and resisting arrest.

In February 2009 Aguirre was arrested as a suspect in an armed robbery at a Nyeland Acres market, where the victim was held at gunpoint while his person and car were searched before the two suspects fled with his personal possessions. Aguirre was taken into custody at an Oxnard residence, where Ventura County Sheriff’s Department detectives found a loaded handgun. Aguirre was charged with suspicion of kidnapping and felony convicted felon in possession of a firearm.

It is not known when Aguirre fled California and went to Dodge City.

On Sunday a criminal complaint was filed against Aguirre in U.S. District Court in Wichita alleging Aguirre robbed the Bank of America with an accomplice. The bank’s surveillance system captured the robbery and suspects on videotape.

If convicted of the bank robbery charge, Aguirre faces a maximum penalty of 25 years in federal prison and a fine of $250,000. He could also be sentenced to up to 10 years and a fine of up to $250,000 on each count of unlawful possession of a firearm after a felony conviction, and a penalty of not less than five years and a fine of up to $250,000 on the charge of carrying a firearm in furtherance of a crime of violence.

Dodge City Police are still searching for the second suspect in the bank robbery.
